“The Balcony Bill” – SB 721- Inspection of Balconies by 2025

California enacted Senate Bill 721 (“The Balcony Bill” or “SB 721”) on September 17, 2018.  

SB 721 makes mandatory an inspection of all multifamily residential buildings with three or more units with wooden exterior elevated elements (EEE’s), which include balconies, overhead walkways, stairwells, and railings by 2025.

Short-term Rentals in California Coastal Areas Get a Boost

The California Court of Appeals recently confirmed a lower court decision that the City of Manhattan Beach’s ban on short term rentals in coastal zones needed to get coastal commission approval first, before going into effect.   

In Keen v. City of Manhattan Beach (2022) 77 Cal.App.5th 142, the Court held that the California Coastal Act overrides a city or county’s attempt to ban short-term rentals in coastal zones, since the ban restricts coastal access. Any new restrictions on coastal access require approval from the Coastal Commission.

This is not good news for cities, because the Coastal Commission has generally been in favor of short term rentals in coastal zones due to the increased access they provide for more individuals to enjoy California’s beaches.  The Supreme Court declined to hear the case.

CARE (California Alternate Rates for Energy) Issues New Income Qualification Levels

Landlord Attorney San DiegoThe California Alternate Rates for Energy, otherwise known as “CARE” has issued new income qualification levels as of June 1, 2013. These new income levels will be used to determine if an individual or household qualifies for discounted electric and gas rates.

To be eligible for the CARE discount, individuals or households must have gross income below the income stated on the CARE chart. These CARE income levels should be communicated to residents and the applicable prevailing residential gas and electric rate schedule as published by the serving utility shall be posted in a conspicuous place in the Community.

The revised income levels are as follows per number of individuals in the household:

     1 person                                $22,980
     2 persons                              $31,020
     3 persons                              $39,060
     4 persons                              $47,100
     5 persons                              $55,140
     6 persons                              $63,180
     7 persons                                     $71,220
     8 persons                              $79,260
     Each additional person             $8,040

Distribution of the Mobilehome Residency Law (MRL)

Under current law, owners of mobilehome communities are required to distribute to all homeowners a copy of the Mobilehome Residency Law (“MRL”) on or before February 1 of each year when there has been a significant change to the MRL.

Now beginning January 1, 2011, community owners have a choice.  They can either distribute a copy of the MRL to all homeowners, as they did before, OR they can notify all homeowners in writing by February 1 of each year that there has been a significant change in the MRL and notifying the homeowner that he/she can request a copy of the updated MRL from the community management at no charge. Upon a request by a homeowner, Community owners and management are required to provide a copy of the MRL to the homeowner within 7 days of the request.  The request by the homeowner may be verbal or written.

This new change in the law could save community owners time and money. The current MRL is about 20 pages long and copying and distributing the MRL to all homeowners by February 1 can be expensive and time consuming.  With this new law change, community owners only have to provide copies of the updated MRL to a homeowner that requests a copy.

Please remember that this new “written notice of the change in the MRL” and opportunity to request a copy must go out to each homeowner on or before February 1 of each year where there has been a significant change in the MRL from the prior year.  Since there is no definition as to what constitutes a “significant change in the MRL,” it is advised that community owners send this notice out every February 1, regardless, allowing homeowners to request and obtain a copy of the new MRL each year.

As a word of caution, if you decide to send out a written notice to the homeowners of the MRL change instead of the actual MRL, please make sure your management office has an adequate supply of the updated MRL copies on hand to give out to requesting homeowners within 7 days of the request.
